§ 1General provisions
- The provider and operator of the game "Star Manor" (the game) is Andrzej Andelbrat, trading as AllesKlar Service, Lönsweg 30, 21680 Stade, Germany, e-mail: allesklarservice.de@gmail.com, phone: +49 155 10247160 (we, the provider). Full company details are on the Legal notice (Impressum) page.
- The game is a strategy game played in a shared, persistent world. A player develops one stronghold, trains an army, sends troops against barbarian camps and Towers of Glory, may belong to a tribe and competes with other players for glory in seasons. The game is available in a web browser at https://starmanor.live.
- These terms set out the rules for using the game and making in-game purchases, and the rights and obligations of players and the provider. They are available free of charge at https://starmanor.live/regulamin-en.html in a form that can be downloaded, saved and printed.
- By founding a stronghold you confirm that you have read and accept these terms. Acceptance is confirmed again with every purchase.
- These terms are available in Polish and English. You can contact the provider in Polish, German or English.
- A player is any person using the game. A consumer is a player who uses the game for purposes unrelated to their trade, business or profession.
- Test phase. The game is currently in its test phase. The test world may be reset before the official launch of the game; the rules of play may change at that point. What happens to purchased diamonds in that case is set out in § 4(10).
§ 2Using the game
- Using the game is free of charge. Only the diamonds described in § 4 are paid for; buying them is voluntary and is not a condition of playing.
- Stronghold and account. To start, you only need to enter a ruler name. The game does not use passwords: when a stronghold is founded, the player's browser receives a random account key ("account code") and keeps it in its storage. Whoever holds the key has access to the stronghold. The key can be copied in the game (Shop tab → "Account code") to enter the stronghold from another device.
- An e-mail address is optional. Once it has been added and confirmed with the link sent to it, the player can recover the stronghold on a new device or after clearing browser data, buy diamonds, and receive raid alerts. One e-mail address can be assigned to one stronghold.
- The player is responsible for keeping the account key secret and for actions carried out with it. Without a confirmed e-mail address and without a saved key, a stronghold to which access has been lost (for example after clearing browser data) cannot be recovered.
- One person may run one stronghold. The ruler name, tribe name and other content entered by the player must not breach the law, good morals or the rights of third parties (§ 3(2)).
- Technical requirements: a current web browser with JavaScript and local storage (localStorage) enabled, and an internet connection.
- Age. The game may be used by persons aged 13 or over. Persons under 18 may make in-game purchases only with the consent of a parent or legal guardian; by making a purchase the player confirms that they are of age or have such consent.
§ 3The game world and fair play
- Players compete in a shared world run on our server. The world keeps running while a player is away: the stronghold produces resources and may be raided by another player or by a barbarian horde. The outcome of events as calculated by the server is binding. Some strongholds are run by the computer ("computer chieftains"); they are marked as such in the game.
- Fair play applies. In particular, the following are prohibited:
- running more than one stronghold by the same person (multi-accounting),
- using bots, scripts, automation and other tools that automate play,
- exploiting bugs instead of reporting them, interfering with communication with the server, manipulating game data,
- using names that are abusive, vulgar, discriminatory, misleading (for example impersonating the administration) or that infringe third-party rights,
- conduct that hinders other players or disrupts the server.
- Moderation. If the rules are breached we may — depending on the seriousness of the breach — issue a warning, change a prohibited name, withdraw unfairly obtained benefits, withdraw the right to write in the chat, or block access to the stronghold (§ 9(2)). For gross breaches (for example multiple accounts or bots) access may be blocked without prior warning.
- Managing the world. We may pause, change or close the game world — in particular for technical reasons, when the game is updated, or when the number of active players is low. During the test phase the world may be reset (§ 1(7)). Where possible, we announce planned changes in the game in advance.
- Tribe chat. Members of a tribe can write to each other in the tribe chat. Messages are visible to all members of that tribe and to the administrator. Prohibited content includes in particular abusive, vulgar or discriminatory content, threats, harassment, spam and advertising, content unsuitable for children, sharing contact details, and attempts to obtain data, account keys or money by deception. The chat automatically rejects swear words, web addresses, e-mail addresses and phone numbers, and limits how fast you can write. Every tribe member can report another member's message; a message reported by two members is hidden automatically. The tribe chieftain can delete a message and mute a tribe member for 24 hours. We may hide a message that breaches these rules and withdraw a player's right to write, temporarily or permanently. The chat keeps the last 100 messages of a tribe — older ones are deleted automatically, and all of them disappear when the tribe ceases to exist. The chat is not a way of contacting support; complaints are handled under § 6.
- Game state has no monetary value. Resources, troops, buildings, glory, titles, ranking position, diamonds and other elements of the game state are solely elements of play. They have no monetary value, cannot be exchanged for money or other benefits, and cannot be transferred or sold between players. Losing them as a result of play (for example a raid) gives rise to no claims against the provider. This does not affect the rights relating to purchased diamonds set out in § 4, § 6 and § 9.
§ 4Buying diamonds
- Diamonds can be purchased in the game. Diamonds are consumable digital content: the player spends them in the game on speeding up construction and training, resource deliveries, a protective shield and Premium status. Diamonds buy time and convenience; they do not raise the development caps of a stronghold. A small number of diamonds is also given free of charge during play. Diamonds have no monetary value and cannot be exchanged for money.
- Current offer and prices:
The price in Polish zloty (PLN) applies when the game is played in Polish; the price in euro (EUR) applies in all other languages. Prices are final prices. The provider is a small business within the meaning of § 19 of the German VAT Act (UStG) — VAT is neither charged nor shown. The price that applies to a given purchase is always displayed on the purchase button before the payment is confirmed.
Pack Diamonds EUR PLN Handful 200 €2.49 PLN 9.99 Pouch 600 €5.99 PLN 24.99 Chest 1500 €11.99 PLN 49.99 Treasury 4000 €27.99 PLN 119.99 - Purchases require a confirmed e-mail address (§ 2(3)). It ensures that the player does not lose purchased diamonds together with their browser data, and lets us send a purchase confirmation.
- Payment is handled by the payment provider Stripe. The available payment methods are shown by Stripe on the payment page. Payment details are given directly to the payment provider; we do not receive them.
- Conclusion of the contract. The presentation of packs in the game is an invitation to make an offer. The player makes an offer by clicking the purchase button marked as creating an obligation to pay ("Buy and pay") and making the payment. The contract is concluded when the payment provider confirms the payment. The consumer receives confirmation of the contract by e-mail at the account address.
- Delivery. Purchased diamonds are added to the player's stronghold immediately after the payment is confirmed — usually within a few seconds, within a few minutes at the latest. If the diamonds do not appear in the stronghold, § 6 applies.
- Diamonds are tied to the stronghold for which they were bought. They cannot be resold or moved to another stronghold.
- Diamonds do not expire over time.
- We may change the offer and prices for the future. Changes do not affect purchases already made.
- Reset of the test world. If the test world is reset (§ 1(7)), all diamonds purchased up to that day — including those already spent — will be credited again to the stronghold that the player founds in the new world and links to the same e-mail address. In case of any difficulty, simply write to the address given in § 1(1).
§ 5Right of withdrawal (consumers)
- A consumer who has concluded a distance contract with us has the right to withdraw from it within 14 days without giving any reason. The period runs from the day the contract is concluded (§ 4(5)).
- To withdraw from the contract, it is sufficient to send an unequivocal statement — most simply by e-mail to allesklarservice.de@gmail.com. You may use the model withdrawal form at the end of these terms, but this is not obligatory. To meet the withdrawal deadline, it is sufficient to send the statement before the period expires.
- In the event of an effective withdrawal we will reimburse all payments received without undue delay and no later than 14 days from receipt of the statement, using the same means of payment as used for the original transaction, unless the consumer has expressly agreed otherwise. The reimbursement involves no cost to the consumer.
-
Loss of the right of withdrawal on immediate delivery
Diamonds are delivered immediately after payment. Under Article 38(13) of the Polish Consumer Rights Act, § 356(5) of the German Civil Code (BGB) and Article 16(m) of Directive 2011/83/EU, the right of withdrawal from a contract for the supply of digital content not supplied on a tangible medium does not apply if performance has begun with the consumer's prior express consent before the withdrawal period expires, after the consumer has been informed that they thereby lose the right of withdrawal, and the provider has given the consumer confirmation of the contract and of that consent.
For that reason, before paying, the player ticks a consent above the purchase buttons reading: "I want to receive the diamonds immediately and I acknowledge that I lose my right of withdrawal once they are delivered. I accept the Terms of Service." Without ticking this consent, an in-game purchase is not possible. The right of withdrawal expires once the diamonds are added to the stronghold. We send confirmation of the contract together with this consent by e-mail.
- Loss of the right of withdrawal does not limit the consumer's rights in respect of the digital content's lack of conformity with the contract (§ 6).
§ 6Complaints
- Complaints about the game and purchases can be sent by e-mail to allesklarservice.de@gmail.com. Please include: the account e-mail address or ruler name, a description of the problem, the date it occurred and, for purchases, the purchase date and the name of the pack (a payment confirmation is helpful).
- We reply to a complaint within 14 days of receiving it, at the e-mail address it was sent from. If we do not reply within that period, the consumer's complaint is deemed accepted.
- We are liable for the conformity of digital content with the contract under consumer law (in Poland: Chapter 5b of the Consumer Rights Act; in Germany: §§ 327 et seq. BGB).
- If purchased diamonds have not appeared in the stronghold, we first add them manually. If that is not possible within a reasonable time, or the player does not want it, we refund the amount paid using the same payment method.
- Complaints do not cover the loss of elements of the game state that results from play itself (for example a lost battle, a plundered stronghold, the actions of other players), or the loss of access to a stronghold caused by losing the account key (§ 2(4)).
§ 7Personal data
- The rules for processing players' personal data — including the e-mail address, purchase data, tribe chat messages and technical data — and the rights of data subjects are described in the Privacy Policy, which is a separate document.
- The data controller is the provider named in § 1(1).
§ 8Liability
- The game is provided free of charge "as is", to the extent permitted by law. We make every effort to keep it stable and free of errors, but we do not guarantee uninterrupted availability — especially during the test phase.
- To the extent permitted by law, we are not liable for:
- technical interruptions, maintenance work, failures of the server, the connection or external services (hosting, Stripe) and their effects on play,
- loss of access to a stronghold caused by losing the account key, where the player neither confirmed an e-mail address nor saved the key,
- the actions of other players, including raids on the stronghold and the effects of rule-breaking before it is detected,
- the effects of using the game in breach of these terms, on outdated software or over an unstable internet connection.
- The limitations of liability do not apply to damage caused intentionally or by gross negligence, to injury to life, body or health, to liability under a guarantee or for the conformity of paid digital content with the contract, or to other cases in which the law does not allow liability towards consumers to be excluded or limited. Where a material contractual obligation is breached through ordinary negligence, we are liable for typical and foreseeable damage.
- The player is liable for damage caused to the provider or to other players by a culpable breach of these terms.
§ 9Termination
- By the player. The player may stop using the game at any time. The e-mail address can be removed by the player in the game (Shop tab → Account → "Remove address"). Deletion of the stronghold and the remaining data can be requested by e-mail — the procedure is described in the Privacy Policy. Deleting a stronghold is irreversible and also covers purchased but unused diamonds.
- Blocking by the provider. We may block access to the stronghold of a player who breaches these terms, after a prior warning; for gross breaches (§ 3(3)) — without warning. We give notice of the block and the reason for it by e-mail, if the player has provided an address. The player may respond to the block through the complaints procedure (§ 6). A block caused by the player's own fault does not entitle the player to a refund, unless the law provides otherwise.
- End of the service. We may stop providing the game on 30 days' notice, announced on the game website and by e-mail to players who have confirmed an address — so that they can use the diamonds they hold. This does not apply to the reset of the test world referred to in § 4(10).
- The consumer's statutory rights remain unaffected.
§ 10Changes to these terms
- We may change these terms for important reasons, in particular: a change in the law, a change in the scope or operation of the game, the end of the test phase, the addition of new features or digital content, a change of payment provider, or the need to prevent abuse.
- A new version of the terms is published on this page with the date from which it applies. Changes do not have retroactive effect and do not affect purchases made before they take effect.
- Players who have confirmed an e-mail address are informed of material changes by e-mail at least 14 days before they take effect; other players — by a notice in the game. A player who does not accept the changes may stop using the game before they take effect (§ 9(1)). Continued use of the game after the changes take effect constitutes acceptance.
§ 11Governing law and disputes
- Contracts concluded under these terms are governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
- The choice of law does not deprive the consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence (Article 6(2) of the Rome I Regulation).
- The competent court is determined by the general rules. A consumer may bring proceedings before the court for their place of residence or for the provider's place of business.
- The provider is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 of the German Consumer Dispute Resolution Act, VSBG). This does not exclude the consumer's use of the out-of-court complaint and redress procedures available under the law of their country of residence.
- We try to resolve disputes amicably. You can write to us about any matter at allesklarservice.de@gmail.com.
- If any provision of these terms proves invalid or ineffective, the remaining provisions remain in force; the applicable statutory provisions apply in place of the invalid provision.
